A Formal Notice & Official Response
Without any reference to federal or state law or regulation to support, Dr. Bennett made a blatantly inaccurate statement by declaring that "Fee splitting…is illegal in all 50 states."
However, it is important to note that regulations may vary by state regarding this matter and, in Arizona, proper fee splitting is perfectly legal pursuant to the established Arizona Administrative Code, Title 4, Chapter 7, Article 9, Section 902 (34) [R4-7-902 (34)].
Highlighting this inaccuracy, Senator Shamp, sent a “formal notice” to Dr. Bennett on May 7th including highlighting the
“importance of accurately representing legal facts in official communications….expect[ing] all members of the Board to adhere to the highest standards of professionalism and accuracy in their communications.”
Wasting no time, Dr. Bennett replied to Shamp’s email within minutes, acknowledging her “formal notice” while proclaiming his reply as his “official response” to her notice.
He stated his disagreement with her allegations on “multiple grounds,” while, again, neglecting to reference any specific state or federal law or regulations to bolster his disagreement.
